The true test of having the Holy Spirit IS NOT SPEAKING IN TONGUES!
It is the FRUIT OF THE SPIRIT!
1 Corinthians 12:28-31
28And God hath set some in the church, first apostles, secondarily prophets, thirdly teachers, after that miracles, then gifts of healings, helps, governments, diversities of tongues. 29Are all apostles? are all prophets? are all teachers? are all workers of miracles? 30Have all the gifts of healing? do all speak with tongues? do all interpret? 31But covet earnestly the best gifts: and yet shew I unto you a more excellent way.
The simple answer to each one of these questions is a SOLID NO! All are not prophets, all are not teachers, all do not have the gifts of healing and ALL DO NOT SPEAK IN TONGUES! 
Those that have told others in the Church that they do not have the Holy Spirit unless they speak in tongues have spoken lies! Maybe, unknowingly, because they were taught that, but as you grow in the LORD you are to study the Word for yourself to show yourself approved unto God a workman that needs not to be ashamed! I have had a few worried baby Christians asking me if they have to speak in tongues to have the Holy Spirit. I have told them all NO! When someone preaches or teaches this to young believers they cast a stumbling block before them and they get very discouraged.
2 Timothy 2:15
Study to shew thyself approved unto God, a workman that needeth not to be ashamed, rightly dividing the word of truth.
1 Corinthians 13:1-3
Love
1Though I speak with the tongues of men and of angels, and have not charity, I am become as sounding brass, or a tinkling cymbal. 2And though I have the gift of prophecy, and understand all mysteries, and all knowledge; and though I have all faith, so that I could remove mountains, and have not charity, I am nothing. 3And though I bestow all my goods to feed the poor, and though I give my body to be burned, and have not charity, it profiteth me nothing.
Now let’s go to the Word of God and rightly divide the Word to end this unbiblical doctrine preached in Charismatic Churches and Pentecostal Churches.
John 3:3-8
3Jesus answered and said unto him, Verily, verily, I say unto thee, Except a man be born again, he cannot see the kingdom of God. 4Nicodemus saith unto him, How can a man be born when he is old? can he enter the second time into his mother’s womb, and be born? 5Jesus answered, Verily, verily, I say unto thee, Except a man be born of water and of the Spirit, he cannot enter into the kingdom of God. 6That which is born of the flesh is flesh; and that which is born of the Spirit is spirit. 7Marvel not that I said unto thee, Ye must be born again. 8The wind bloweth where it listeth, and thou hearest the sound thereof, but canst not tell whence it cometh, and whither it goeth: so is every one that is born of the Spirit.
When you are born again, it is not your physical body that is reborn, but it is your spirit-man in you. This is written in the Word of God that shows us a few that were born again after the resurrection but before the ascension.
John 20:21-22
21Then said Jesus to them again, Peace be unto you: as my Father hath sent me, even so send I you. 22And when he had said this, he breathed on them, and saith unto them, Receive ye the Holy Ghost:
There in that room was 10 of the disciples of Jesus Christ, all except Judas Iscariot who killed himself and Thomas was not there at the time. 
Now when Jesus breathed on them He said, “receive ye the Holy Ghost.” That was giving them life by giving them a new spirit by being born again by the Spirit! Before we are born again of the Spirit we are basically dead men walking.
Now let’s go and find the law of first fines to see if this is true, ok?
Genesis 2:7
7And the LORD God formed man of the dust of the ground, and breathed into his nostrils the breath of life; and man became a living soul.
When Adam was created from the dust there was no life in him until the LORD breathed in his nostrils, and he became a living soul. Correct? When Adam and Eve sinned what happened? They DIED SPIRITUALLY and their flesh would now begin to age, wear out, and eventually die as well.
Genesis 2:17
But of the tree of the knowledge of good and evil, thou shalt not eat of it: for in the day that thou eatest thereof thou shalt surely die.
The exact same this can happen to us if we begin to willfully sin after being born again! You still are a child of God, but to Him you are dead.
Proof?
Luke 15:24
For this my son was dead, and is alive again; he was lost, and is found. And they began to be merry.
Luke 15:32
It was meet that we should make merry, and be glad: for this thy brother was dead, and is alive again; and was lost, and is found.
As you have read Adam became a living soul by the breath of the LORD. The 10 disciples became a living soul by the breath of the LORD when He breathed on them. Adam was born, the disciple was born again.
None of them spoke in tongues at this moment but the had received the Holy Spirit because they were now born of the Spirit.
Now let’s look at the baptism of the Holy Ghost.
Matthew 3:11
I indeed baptize you with water unto repentance: but he that cometh after me is mightier than I, whose shoes I am not worthy to bear: he shall baptize you with the Holy Ghost, and with fire:
Did you read that? HE SHALL BAPTIZE YOU WITH THE HOLY GHOST, AND FIRE!!! BAPTIZE YOU! That is different from being born again by the Spirit, these should not be confused.
Everyone that is BORN AGAIN OF THE SPIRIT has the HOLY SPIRIT IN THEM! EVERYONE! If you don’t then you are not BORN AGAIN! What is the evidence of the new birth? A transformed life! A new creation. You no longer love your sin, you hate your sin. You no longer hate your enemy you love and weep for your enemy!
Remember before Pentecost Jesus had already breathed on them, saying, “receive ye the Holy Ghost.” This the new birth into life, the following is the literal baptism of the Holy Ghost and fire.
Acts 2:1-4
1And when the day of Pentecost was fully come, they were all with one accord in one place. 2And suddenly there came a sound from heaven as of a rushing mighty wind, and it filled all the house where they were sitting. 3And there appeared unto them cloven tongues like as of fire, and it sat upon each of them. 4And they were all filled with the Holy Ghost, and began to speak with other tongues, as the Spirit gave them utterance.
Notice in order to receive the GIFT of the Holy Ghost, you first must BELIEVE and REPENT. You cannot, and I repeat cannot be born again without repentance! Remember the 10 that Jesus Christ breathed on? They BELIEVED did they not? What about repentance though? Somewhere between denying Jesus and eating the fish breakfast Jesus made them Peter repented. How do we know this?
Peter needs to be converted:
Luke 22:32
But I have prayed for thee, that thy faith fail not: and when thou art converted, strengthen thy brethren.
Somewhere between Luke 22:32 and John 20:21-22 , Peter repented for denying Jesus.
John 20:21-22
21Then said Jesus to them again, Peace be unto you: as my Father hath sent me, even so send I you. 22And when he had said this, he breathed on them, and saith unto them, Receive ye the Holy Ghost:
The following verses tell us Peter has been forgiven, converted and now commissioned to feed/strengthen his brethren.
John 21:15-17
15So when they had dined, Jesus saith to Simon Peter, Simon, son of Jonas, lovest thou me more than these? He saith unto him, Yea, Lord; thou knowest that I love thee. He saith unto him, Feed my lambs. 16He saith to him again the second time, Simon, son of Jonas, lovest thou me? He saith unto him, Yea, Lord; thou knowest that I love thee. He saith unto him, Feed my sheep. 17He saith unto him the third time, Simon, son of Jonas, lovest thou me? Peter was grieved because he said unto him the third time, Lovest thou me? And he said unto him, Lord, thou knowest all things; thou knowest that I love thee. Jesus saith unto him, Feed my sheep.
God uses Peter mightily after being baptized with the Holy Ghost.
Acts 2:38-39
38Then Peter said unto them, Repent, and be baptized every one of you in the name of Jesus Christ for the remission of sins, and ye shall receive the gift of the Holy Ghost. 39For the promise is unto you, and to your children, and to all that are afar off, even as many as the Lord our God shall call.
Those scriptures tell us very clearly the gifts are in operation today without a doubt. But just because some appear to be used in the gifts you better be certain they have the Holy Spirit’sDo You Have To Speak fruit first.
The following scriptures back up that not everyone will be used in the gift of tongues, it is up to the Holy Spirit who uses this gift and who doesn’t. But we all should be producing the Fruit of the Spirit.
1 Corinthians 12:4-13
4Now there are diversities of gifts, but the same Spirit. 5And there are differences of administrations, but the same Lord. 6And there are diversities of operations, but it is the same God which worketh all in all. 7But the manifestation of the Spirit is given to every man to profit withal. 8For to one is given by the Spirit the word of wisdom; to another the word of knowledge by the same Spirit; 9To another faith by the same Spirit; to another the gifts of healing by the same Spirit; 10To another the working of miracles; to another prophecy; to another discerning of spirits; to another divers kinds of tongues; to another the interpretation of tongues: 11But all these worketh that one and the selfsame Spirit, dividing to every man severally as he will. 12For as the body is one, and hath many members, and all the members of that one body, being many, are one body: so also is Christ. 13For by one Spirit are we all baptized into one body, whether we be Jews or Gentiles, whether we be bond or free; and have been all made to drink into one Spirit.
There is a false spirit in many “believers” these days. There are counterfeit gifts, speaking in tongues is a huge one. There are many in the pulpit and the pews that will speak in tongues and be as crooked as the day is long. They will gossip and speak in tongues, they will swear like a sailor and speak in tongues, they will complain and hold unforgiveness and speak in tongues. There are many with a self-righteous proud spirit and speak in tongues. There are some who refuse to be taught or learn by others and speak in tongues.
The fruit cannot be counterfeit for a long period of time but sadly the gifts can. my family in Christ be wider as serpents but gentle as doves. If those who are professing Christ as their LORD and Savior yet sin willfully and speak in tongues, you would do well to remove yourself from their company.
